Toyota to pay US government $16.4 million over recalls

Toyota has agreed to pay a record $16.4 million fine to the US government over allegations that the automaker concealed defects in its vehicles.

Toyota has accepted responsibility for violating its legal obligations to report any defects promptly

US Transportation Secretary Ray LaHood made the announcement Monday, saying in an e-mailed statement that “Toyota has accepted responsibility for violating its legal obligations to report any defects promptly.” Toyota has still not admitted any wrongdoing, and said that it disagreed with the National Highway Traffic Safety Administration (NHTSA), which levied the fine against Toyota. In a statement, Toyota said it “denies N.H.T.S.A.’s allegation that it violated the Safety Act or its implementing regulations. We believe we made a good faith effort to investigate this condition and develop an appropriate counter-measure.”

Toyota is still at risk of lawsuits from those affected by cars that crashed due to a safety defect in the accelerator pedal. Numerous such lawsuits have been filed, and analysts said that the total cost of the lawsuits could be upwards of two billion dollars in 2010, and possibly as much as ten billion in total. While the government fine is largely symbolic, as the amount was limited by US law, it could provide support for lawyers who are filing legal charges against Toyota. If the cap on the fine was not in place, Toyota would have been fined a total of $13.8 billion; each of the 2.3 million defective vehicles sold would have had a $6,000 fine.

Additionally, the NHTSA is reportedly considering a second fine, also of $16.4 million, based on evidence that there were two separate defects in the affected vehicles, and the company is facing an investigation from both the Justice Department and the Securities and Exchange Commission.

Volvo announces all new car models electric or hybrid from 2019

On Wednesday, automobile company Volvo announced all of its cars to be released in 2019 onwards are to use some form of battery-powered engine, leaving conventional petrol-only vehicles altogether. The decision comes after Volvo announced in May their intent to cease production of diesel vehicles.

The chief executive of Volvo Cars, Håkan Samuelsson, said, “People increasingly demand electrified cars”. Volvo aims to release five new electric vehicle models between 2019 and 2021. While little has yet been revealed about them, the company has stated two of them are to be high-performance electric vehicles, branded as Polestars.

Other car models from 2019 may be plug-in hybrid or 48-volt “mild hybrid” systems. Audi and Mercedes-Benz are also releasing mild hybrid cars for the European market.

“This announcement marks the end of the solely combustion engine-powered car. Volvo Cars has stated that it plans to have sold a total of 1m electrified cars by 2025. When we said it we meant it. This is how we are going to do it,” Samuelsson said. Volvo is owned by Chinese automotive giant Geely, and China’s Ministry of Industry and Information Technology has said by 2025 they want new vehicle sales to be 20 percent “new energy vehicles”.

Early morning fire kills four New York group home residents

After an early morning fire began, four out of the nine people living at the Riverview Individual Residential Alternative group home located in Wells, New York were killed by the blaze. The Sunmount Developmental Disabilities Services Office, which supervises the home, told the media that the fire started at approximately 5:30 AM Eastern Daylight Time. Two staff members were at the home at the time, who safely evacuated four of the five survivors.

The names of the residents killed in the fire were not able to be released due to New York’s Mental Hygiene Law, but are able to be identified as two adult men, aged 32 and 52, and two adult women, aged 43 and 60. A 71-year-old male was injured in the fire, and was taken to a hospital in Utica, a nearby city. The other four residents have been relocated to an unnamed group home. Both staff members are also being examined at the hospital.

“On behalf of all New Yorkers, I wish to extend my heartfelt condolences to the families, loved ones and friends of the four victims and to continue to pray for the full recovery of those five people and two staff members who survived this incident. I also want to express my thanks and appreciation for the first responders and volunteers who worked swiftly and diligently to respond to this tragedy,” David Patterson, the governor of New York, said to the media.

The exact cause of the fire has yet to be determined. However, the New York Civil Liberties Union stated that “the blaze appears to have been an electrical fire and the sprinkler system was knocked out immediately.” They also called for “an immediate investigation into the causes of and contributing factors of the fire.”

The New York State Department of State Office of Fire Prevention and Control is currently investigating the causes of the blaze, with help from New York State Police Bureau of Criminal Investigation and the New York State Commission on Quality of Care and Advocacy for Persons with Disabilities.

Suspect in gay bar attack dies after gunfight with police

The man who was suspected of attacking three men in a gay bar in Massachusetts died early Sunday morning after being shot in a gun battle with Arkansas State Police.

Jacob D. Robida, 18, fled Massachusetts on Friday after a warrant was put out for his arrest in the aforementioned gay bar attack. Along the way he picked up his girlfriend, 33-year-old Jennifer Rena Bailey, in Charleston, West Virginia. Robida was pulled over in a traffic stop by Gassville, Arkansas Police Officer Jim Sell. Sell asked Robida to get out of the car, and Robida shot him three times before getting back in the car and leaving. A witness called 911, but Sell died at the scene.

Robida led Baxter County, Arkansas sheriff’s officers and Arkansas State Police officers on a high-speed chase. Robida ran over spike strips in Norfolk and drove on two flat tires for a while. He ultimately wrecked his car into some parked vehicles while trying to avoid a roadblock on Arkansas State Road 5. Robida shot at the officers, who returned fire, shooting Robida twice in the head. Bailey was killed in the gunfight; though some witness said Robida shot her before firing on the officers, an autopsy and forensic investigation will determine how she died.

Robida was rushed to Cox-South Hospital in Springfield, Arkansas, where he was pronounced dead at 3:38 a.m. CST (0938 UTC).

Microsoft buys online ad firm Aquantive for $6 billion

Microsoft have today paid $6 billion (£3 billion) for the online marketing firm Aquantive. The takeover will pave the way for Microsoft to expand into the $40 billion online advertising market currently dominated by Google and Yahoo!.

Kevin Johnson, the head of Microsoft’s platforms and services division, said “This deal takes our advertising business to a new level” and follows the recent acquisitions by Google and Yahoo who bought DoubleClick for $3.1 billion, and the remaining 80% of Right Media Exchange for $680 million respectively.

Aquantive will remain at its base in Seattle with its current staff of around 2.600, but will work as part of Microsoft’s online operations.

The deal is expected to be completed by early 2008, subject to regulation.

Minnesota Governor opposes state funds to Iran-tied company

Minnesota Governor Tim Pawlenty said today that Essar Global has committed to fully comply with all U.S. and international law, including those prohibiting certain investments in Iran, and that he will support continued state assistance for Essar’s proposed steel project on the Iron Range.

A few days after Indian company Essar Steel Holdings Limited acquired Minnesota Steel LLC, the governor of Minnesota announced that he “will strongly oppose any effort to provide state financial assistance to companies or entities that engage in prohibited business practices with Iran.”

Governor Pawlenty recently returned from a trip to India. He learned that Indian company Essar Global Limited is pursuing a project to build a refinery in southern Iran.

There is no official word yet from Essar Group, but Iran’s Petroenergy Information Network says Essar Group is expected to take a 60% stake in the project and that Essar’s Ravi Ruia was negotiating for the project in Iran last week.

The northern Minnesota project will be the first facility which includes all steps in steel production from iron mining to a US$1.65 billion steel mill. The Iranian refinery will have a capacity of 300,000 barrels per day and cost $8-10 billion.

Spelbound declared winner of Britain’s Got Talent 2010

An acrobatic group known by the name of Spelbound has been declared as the winner of Britain’s Got Talent 2010, a televised variety talent show competition broadcast on ITV in the United Kingdom. As the winning act of the show, Spelbound have won £100,000 (US$144,580, 120,313, A$175,079) and a place at The Royal Variety Performance, an annual gala evening that is attended by senior members of the British Royal Family.

In no particular order, the top three acts were revealed to be two dancers known by their stage name of Twist and Pulse, gymnastic group Spelbound and Kieran Gaffney, whose act involves playing on the drum kit. After Kieran Gaffney was revealed to be in third place, Anthony McPartlin, who hosts Britain’s Got Talent with Declan Donnelly, said to Kieran: “Well done Kieran. Kieran, you’re a star, you came back, you got all the way to the final. I know you’ve loved this. You’ve loved this, haven’t you?” In response to this, Kieran Gaffney stated: “Thank you very much. Thank you, everyone for supporting me. Thank you.”

Shortly afterwards, on the episode that was broadcast live on ITV1 on Saturday, Anthony announced: “After tens of thousands of auditons, five semi-finals and an amazing final, this…this is it. One of you is about to walk away with £100,000 and a place at this year’s Royal Variety Performance. The winner of Britain’s Got Talent 2010 is…Spelbound!” Glen Murphy from Twist and Pulse commented about finishing in second place, stating: “Yeah, it’s amazing. I can’t even believe it. I can’t believe it at all.”

Alex Uttley, a 24-year-old member of Spelbound, commented on the gymnastic group’s victory, commenting: “Oh, my god. This is unbelieveable. We just want to say thank you to everyone out there. It just shows that all our hard work has paid off.” One of the coaches of Spelbound, named Neil Griffiths, stated about Spelbound: “Oh, they’ve worked so hard over the last few weeks. Um, since the semi-final, we…we really had to pull out the stops to try and up the game. They’ve not known they’ve worked in the gym from six in the morning till twelve…twelve o’clock of the night. I couldn’t have asked for more. Um, it’s a team of coaches. I don’t take all the credit myself. There’s, uh, two people up there that know who they are who’ve been fantastic.”

Spelbound consists of 24-year-old Alex Uttley, Nicholas Illingworth, aged 24, Adam Buckingham, aged 21, 20-year-old Adam McAssey, 19-year-old Douglas Fordyce, 18-year-old Edward Upcott, 18-year-old Leighanne Cowler, 17-year-old Katie Axten, 17-year-old Lauren Kemp, 15-year-old Jonathan Stranks, Abigail Ralph, aged 15, 13-year-old Hollianne Wood and Amy Mackenzie, aged 12. Bookmakers had previously predicted that Spelbound would be the most likely act to become the winner of the series.

The running order for the final started with Twist and Pulse. The second act to perform was Liam McNally, a 14-year-old singer. The running order subsequently continued with 40-year-old impressionist Paul Burling, singer Christopher Stone, aged 28, Tina & Chandi, a woman and dog dancing act, Connected, a five-piece singing group, Kieran Gaffney, aged 12, 22-year-old Tobias Mead, a dancer, 80-year-old singer Janey Cutler and Spelbound in that particular order.

Earlier on in the final, Britain’s Got Talent judge Amanda Holden has stated to Spelbound: “We are hosting the 2012 Olympics and I think ‘what a brilliant opening act’.” Fellow judge Piers Morgan also commented that “[t]he purpose of this show is to identify hidden great British talent. You are that act.” After Spelbound won in the final, another judge, named Simon Cowell, stated that “the right boys and girls won on the night” and that he could “only say on live TV that that was one of the most astonishing things I have ever seen. Seriously.”

Íngrid Betancourt returns to France

Freed hostage Íngrid Betancourt arrived in France today, two days after being rescued from the Revolutionary Armed Forces of Colombia (FARC), who had kept her captive in the Colombian jungle for more than six years.

Standing alongside President Nicolas Sarkozy at a military air base southwest of Paris, Betancourt said, “I cry with joy.” The Colombian-French politician was greeted at the air base by the President and the First Lady, Carla Bruni-Sarkozy, along with some supporters.

“I have been dreaming for seven years of this moment. I owe everything to you,” she said, thanking France for pressuring Colombia to “think of other than military options”. She added, “France is my home and you are my family.” Sarkozy said her safe return shows people in difficult situations that “there is hope, light at the end of the tunnel.”

After the welcome at the air base, which was broadcast live on national television, Betancourt went to the Élysée Palace, the President’s official residence. Again accompanied by Sarkozy, she recounted her experiences as a hostage in the Colombian jungle, describing the lack of sunlight and hostile conditions.

“It’s a completely hostile environment with dangerous animals,” Betancourt said. “The most dangerous, of course, is man. Those men who were behind me with huge rifles, pushing me, telling me to walk, telling me to walk more quickly. And in this world of hostility where everything is an enemy, dangerous, against you, there is God. And above all, there was you.”

She called on Sarkozy to continue working toward freeing the hostages who were left behind. “We cannot leave them there where they are suffering, where they are alone,” she stated, saying that some of them are contemplating suicide. In response, Sarkozy said, “We will carry on working to free them.”

Betancourt was one of the 15 hostages rescued on July 2 by the Colombian army, who tricked FARC into handing over the hostages by pretending to be part of a non-governmental organization. She was kidnapped in February 2002 while campaigning for President of Colombia.

At a press conference, her third public event in the hours since returning to France, Betancourt condemned the actions of FARC. “I think the whole world is aware of the fact that FARC inflicts suffering on human beings”, she said, calling on the guerrilla organization to “accept defeat gracefully” and “stop being terrorists.” She called on the international community to help end the “terrible trend of kidnapping in Colombia”.

Betancourt also rejected the idea that the rescue operation was staged to cover up ransom payments to FARC. “I think what I saw was certainly not a staged event,” she said. “There was a degree of tension.”

A second commercial model is called the external vac sealer where the plastic bag is attached externally. These are also called clamp-type sealers because they clamp down around the outside of the bag. These machines require a special bag with air channels for drawing out the air. Practically maintenance free this home model is the most inexpensive of the models. The bags used are boilable but they are expensive.

When the external vac sealer is bought from a discount store it will probably not be able to handle sealing more than once or twice a day. Prolonged use will cause overheating. USPTO partially confirms validity of Amazon “1-click patent”

Today, the United States Patent and Trademark Office (USPTO) issued an office action, which confirmed the patentability of claims 6 to 10 of the Amazon 1-Click patent, US 5,960,411. The patent examiner, however, rejected claims 1 to 5 and 11 to 15. Amazon now has up to six months to amend the rejected claims to overcome the examiner’s rejection, provide arguments to demonstrate that the examiner is in error and/or provide evidence to demonstrate the patentability of their claims. During this period, the entire patent is still considered valid under US patent law.

The USPTO is reconsidering the patentability of the claims due to a request for reexamination filed by New Zealander Peter Calveley. Mr. Calveley used internet archives to show that defunct company Digi Cash used a similar technique prior to Amazon. Despite costing a substantial sum of cash and requiring donations to prepare and file the request for reexamination, Calveley said he did it as a game and hopes that his success inspires others to play the same game.

“One Click” shopping is an ecommerce technique, which allows a customer to purchase products via the Internet without repeatedly entering personal information such as name and address. At the time it was introduced it eased the frustration of on-line shopping.

Amazon filed the patent application for 1-click shopping in early 1997 and was granted the patent in September 1999. 23 days later Amazon sued rival Barnes & Noble for alleged infringement by its “Express Lane” ordering which was introduced in 1998. In December 1999 Amazon won an interim injunction against Barnes & Noble but the USA Court of Appeals for the Federal Circuit lifted this injunction in February 2001. The parties then settled their dispute for undisclosed terms. Amazon has since successfully licensed the technique to other e-sellers such as Apple.
