Fourth U.S. state governor orders net neutrality in government contracts

On Thursday, Phil Scott of Vermont became the fourth governor in the United States to sign an executive order requiring all companies providing Internet access to state agencies to abide by net neutrality for all customers in his state. He said he did this because Vermonters rely on Internet access without blocking, throttling and paid prioritization, threatened by the December 14 decision of the US Federal Communications Commission (FCC) in the matter of “Restoring Internet freedom”. The first state governor to challenge the FCC in this way was Steve Bulllock of Montana, who did so on January 22. Andrew Cuomo of New York followed two days later. Philip Murphy of New Jersey signed a similar executive order on February 5. These four executive orders differ in details, but all require that state agencies purchase Internet access services only from companies with an enforceable commitment to net neutrality for all customers in their state.

This is part of a flurry of state-level net neutrality actions. The New York State Assembly introduced bill A01958 on January 17, 2017, three days before the inauguration of Donald Trump as President of the United States, anticipating action by him to overturn the 2015 “Title II Order” that made net neutrality enforceable in the US. Two other bills were introduced into the Washington House of Representatives in the ten days before the official decision of Trump’s FCC on this issue. In addition to these, 63 other state-level responses by net neutrality supporters were documented by Fight for the Future (FFTF) by February 16, 2018, including at least 27 bills introduced into the legislatures of 17 states with others reportedly under consideration.

These bills are in addition to the lawsuit filed on January 16 by the Attorney General of New York on behalf of 21 states and the District of Columbia claiming this FCC decision was “arbitrary, capricious, and an abuse of discretion within the meaning of the Administrative Procedure Act” (APA) of 1946 and other grounds. These states were New York, California, Connecticut, Delaware, Hawaii, Illinois, Iowa, Kentucky, Maine, Maryland, Massachusetts, Minnesota, Mississippi, New Mexico, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, and Washington state. New Jersey reportedly later committed to join the suit.

These four executive orders are the only actions on FFTF’s list of actions by net neutrality supporters that seem immediately enforceable. All others require approval by democratic bodies. The four executive orders might be challenged in courts as conflicting with “Preemption authority” claimed by the US Federal Communications Commission’s “Declaratory ruling, report and order” adopted December 14 and released January 4. The FCC order was described by dissenting Commissioner Clyburn as “Destroying Internet Freedom” rather than “Restoring Internet Freedom” as the order is titled. She wrote that this order “will put profits and shareholder returns above what is best for” consumers.

The name Robert Cailliau may not ring a bell to the general public, but his invention is the reason why you are reading this: Dr. Cailliau together with his colleague Sir Tim Berners-Lee invented the World Wide Web, making the internet accessible so it could grow from an academic tool to a mass communication medium. Last January Dr. Cailliau retired from CERN, the European particle physics lab where the WWW emerged.

Wikinews offered the engineer a virtual beer from his native country Belgium, and conducted an e-mail interview with him (which started about three weeks ago) about the history and the future of the web and his life and work.

Wikinews: At the start of this interview, we would like to offer you a fresh pint on a terrace, but since this is an e-mail interview, we will limit ourselves to a virtual beer, which you can enjoy here.

IRS goes after eBay sellers

San Jose, California — As the April 15 deadline for U.S. private citizens to file their 2004 income tax returns draws near, the government is reminding sellers on eBay that they may have to report any proceeds from sales on the auction site as taxable income.

This could be a surprise to some of the 135 million registered eBay users who consider trading on San Jose-based auction site to be a non-taxable hobby. Complicating matters, eBay says it doesn’t report individual sales figures to the government – users are responsible to report any profits on their own tax returns.

The amount of money traveling through eBay is big business. $33.8 billion worth of merchandise was sold on the site in 2004, up from $5.2 billion in 2000.

Although eBay pays taxes on its share of the sales (5.25 percent cut from each transaction as of Feb. 18), the IRS fears some small businesses are using the site to dodge tax responsibility. Adding to the confusion, some sellers may legally be a taxable business without realizing it.

The U.S. Internal Revenue Service has a nine-point checklist it uses to determine whether or not a money-making activity is legally a business, which means money made is taxable, or a simple hobby – where it is not taxable. The IRS can consider a person to be a legal “business” even though they never incorporated or claimed to be one.

According to Woodbury, New York-based accountant Bart Fooden in an Associated Press interview, the IRS looks for such things as evidence that the auction seller depends on the eBay sales income to pay for activities other than maintaining the hobby, acts in a businesslike manner when selling on auctions or puts enough time and effort into the eBay activities that there is an obvious intent to make a profit.

But Fooden said in the same interview casual users probably have nothing to worry about. Those cleaning out closets or the garage and selling off junk for less than the original price paid are not turning a profit, so that money is not considered income and is not taxable.

Daughter of Yuko Ikeda kidnapped to ransom in Tokyo; freed 13 hours later

Ikeda Kanako, a 21-year-old senior student of the Meiji Gakuin University and the first daughter of celebrity surgeon Yuko Ikeda, was kidnapped at about 1225 (UTC+9), June 26, 2006, in Shibuya, Tokyo.

A bullet was fired and one officer slightly cut when police stormed a Kawasaki apartment to rescue the girl.

Kanako was dressed in a white light half-sleeved cardigan, blue jeans with a bistre belt made of leather, a spring green camisole and carried a bag of Vuitton when she was abducted at a bus stop.

She was found unharmed 13 hours later by Japanese police at a condominium located in Nakahara-ku, Kawasaki, Kanagawa. The young woman’s make-up was not disordered; Kanako’s long brown fringe was not disheveled at all and she was wearing what she had been when she was kidnapped.

The kidnapping of Kanako was a big story in Japanese media in June, 2006. The story appeared in many newspapers as the front-page news on June 27, 2006.

Kanako and her kidnappers had been in touch with her mother using Kanako’s mobile phone. The effort to free her was helped greatly by a woman who witnessed the moment Kanako was taken; she wrote down the license plate of the van and other details.

Police traced mobile phone calls and were able to locate the van in Kawasaki where they detained two of the kidnappers as they went shopping.

One conspirator Li Yong, 29, from China, led the policemen to the apartment and tricked Kaneo Ito, 49, from Japan, to open the door. Ito managed to discharge one bullet before being restrained by an assistant police inspector, the first man in the room.

The other man involved in the kidnap of Kanako was Choi Gi Ho, 54, from South Korea. Kanato was freed unharmed.

The Tokyo Metropolitan Police Department arrested three men on suspicion of conspiring to kidnap a woman and hold her to a reported 300 million yen ransom.

Australia to send 200 more troops to Afghanistan

Australia’s Foreign Minister, Alexander Downer, says the Federal government will contribute another 200 troops to assist the Dutch military in a former Taliban stronghold. Australia also pledges $150 million in aid for the reconstruction of Afghanistan.

“We have 190 at the moment, special forces, we’ve got another 110 going there to provide additional support for them with two helicopters, and this would be another 200 on top of that.” Mr Downer said.

Speaking outside a two-day international donors conference in London, Mr Downer said Australia’s commitment to Afghanistan was not as large as some countries, but it would nevertheless make a big difference.

He said Australia would build on the millions it has already spent in Afghanistan, with a new pledge of $150 million over 5 years through aid agency AusAID. Canberra has spent 110 million dollars in the war-torn country since the coalition invaded in late 2001.

Mr Downer joined world leaders in London for the signing of the Afghanistan Compact: “a road-map for international donors and the Government of Afghanistan to work together to rebuild the country into a stable and democratic state.”

Australia’s latest troop commitment, for a provincial reconstruction team in conjunction with the Netherlands, will take its total in Afghanistan to 500 troops. Downer said that the troops would probably be sent to take part in a proposed provincial reconstruction team with Dutch soldiers in the southern province of Uruzgan as early as July.

“July, August would be the pencilled-in planning at the moment, so that would involve Australia sending around 200 troops over and above the troops we already have in Afghanistan,” he said.

Mr Downer said Afghanistan still had a security problem but things were going in the right direction.

“We know how important it is for the new democratic government in Afghanistan and the new free and democratic processes there to survive, and every country that possibly can needs to give support to Afghanistan,” he said.

Under the compact, Afghanistan has pledged to meet targets in security, governance, rule of law and human rights, and economic and social development in return for military and financial aid from its international partners.

Australia also has about 900 troops in Iraq. About 450 of the soldiers are guarding Japanese forces in southern Samawa, which Japanese media reports said could end by May.

Downer said Australia would “wait and see” what Japan would do before deciding whether to bring its Samawa troops home or redeploy them elsewhere in Iraq.

Australia has already committed some 300 troops and support personnel to Afghanistan.

Satire site Uncyclopedia, a parody of online encyclopedia Wikipedia, has been labeled by the Malaysian government as dangerous. The Internal Security Department of Malaysia issued the warning today, saying that the site has “messages and information insulting Malaysia”.

The warning notes the creation date of the website as being 5 January 2005, and hosted by Wikia, Inc., both of which are correct. However, it claims Wikia owns Wikipedia; Wikipedia is a charitable non-profit website owned by the non-profit Wikimedia Foundation, while Wikia is an independent, for-profit company.

The report evidently mentions that Uncyclopedia covers Malaysian “history, culture, the political leaders, the government, the national song and the name / history of the national flag,” none of which is “correct”. They accuse the website of helping to reinforce a bad international image of their country.

There are no reports of the site being blocked from access within the country, only this statement, which urges Malaysians not to circulate the content.

Uncyclopedia’s article on Malaysia begins:

The site has fired back with a parody article posted at the site under their UnNews section, titled Uncyclopedia Internal Security Department warns on Malaysia. The article suggests that the “Internal Security Department of the Uncyclomedia Foundation,” which is a facetious and fictitious parent organization of Uncyclopedia, identifies Malaysia “as a dangerous country… It warned its people not to use the country today.”

There are forty-seven individual language editions of Uncyclopedia, including Tolololpedia, which is written in Bahasa Melayu, the Malay language. This is in addition to fictional “language” editions which include Oscar Wilde, Newspeak, N00b, White Supremacist, and Re: PharmaccgRy.
