Woman finds human finger in bowl of chili at Wendy’s restaurant

San Jose, California — A woman eating a bowl of chili at a Wendy’s restaurant bit into a chewy bit that turned out to be a human finger. She immediately spat it out, warned other patrons to stop eating, and upon recognizing the object as a finger, vomited.

“I’m more of a Carl’s Jr. person,” the 39-year-old Las Vegas woman, Anna Ayala, told Knight Ridder. She said this incident was her first visit to a Wendy’s restaurant. Ayala described how she found the finger, “Suddenly something crunchy was in my mouth,” she continued, “and I spit it out.”

According to Devina Cordero, 20, after Ayala found the finger, she ran up to her and Cordero’s boyfriend and said, “Don’t eat it! Look, there’s a human finger in our chili.”

“We went up to the counter and they told us it was a vegetable,” Cordero continued. “The people from Wendy’s were poking it with a spoon.”

The restaurant is located at 1405 Monterey Highway, just south of downtown San Jose.

Wikinews reporter David Vasquez drove his car up to the drive-thru menu and found that chili was still on the menu, at a price of US$1.19 for a small serving. He also witnessed workers unloading supplies from a semi-trailer truck in the restaurant’s parking lot, and carting them into the back door of the establishment.

According to Ben Gale, director of environmental health for Santa Clara County, the finger did not come from any of the employees at the restaurant. “We asked everybody to show us they have 10 fingers and everything is OK there,” he said. The found portion of the finger likely belonged to a woman because of its long and manicured fingernail, also found in the food.

Officials seized the food supply at the restaurant and are tracing it back to the manufacturer, where they believe the finger may have gotten mixed in with the raw ingredients used to prepare the chili. The restaurant’s operators were later permitted to re-open after preparing new chili prepared from fresh ingredients.

As this story was filed, there was no mention of the incident on the Wendy’s corporate web site. Wendy’s issued a statement through a spokesman.

“Food safety is of utmost importance to us,” said Wendy’s spokesman Joe Desmond. He referred to the incident as an “unsubstantiated claim.”

“We are cooperating fully with the local police and health departments with their investigation. It’s important not to jump to conclusions. Here at Wendy’s we plan to do right by our customers,” Desmond said.

According to county health officials, the unfortunate woman who bit into the finger is doing fine, despite her initial reaction. Officials also noted that the finger would have been cooked at a high enough temperature to destroy any viruses.

The Santa Clara county medical examiner reported that the finger had a solid fingerprint, although investigators did not say if a search of fingerprint databases would be performed to find the owner of the finger.

Bus crash in Victoria, Australia injures twenty, some critical

A bus crash in Victoria, Australia has injured at least 20 people, two of whom are listed as critical. One victim is reported to be still trapped in the wreckage.

The accident occurred between a bus and a semi-trailer on the Princes Highway in the Traralgon area around 10:50am AEST. The La Trobe Valley Busliner bus was traveling east when it collided with the back of a heavy haulage truck.

Those critically injured are being airlifted to a hospital in Melbourne. Others are being transported by Ambulance to La Trobe Valley Hospital in Traralgon.

SES crews are on scene, along with St. John Ambulance and fire crews.

The eastbound lanes of the highway have been blocked by police and traffic is being diverted.

As of 10:00 p.m EST November 8, 2006, the Democratic Party is projected to have gained control of both the United States House of Representatives and the United States Senate in the 2006 United States general elections. MSNBC projects that the Democrats now control 234 seats in the House of Representatives, 16 more seats than the 218 needed to control the House of Representatives as all 435 seats were up for election. In the Senate, where the balance of power is closer, one-third of all seats were up for grab. As of 10:00 p.m. EST, AP and Reuters were projecting that the Democrats had picked up all six seats they needed to retake the Senate, including the seats of incumbents Rick Santorum (Penn.), Lincoln Chafee (R.I.), Jim Talent (Missouri), Mike DeWine (Ohio), John Tester (Montana), and Jim Webb (VA). The Tester victory by less than 3,000 votes was projected at approximately 2 p.m. EST after the State of Montana announced the results of overnight recounts. Democrat Jim Webb has prevailed in that race by slightly more than 7,000 votes, though his opponent has not conceded and a recount may still occur.

Flooding in Nakhon Sri Thammarat

Moderate flooding has hit the province of Nakhon Sri Thammarat in southern Thailand. Moderate to heavy rain persists in the area, further exacerbating the flooding conditions. The northeast monsoon has intensified the flow of rainfall-laden air from the Gulf of Thailand. Torrential rains have been plaguing the nine southernmost provinces of the country for nearly two weeks and further downpours are forecast for later this week.

Thung Song District in Nakhon Sri Thammarat province is experiencing waist-high floodwaters in downtown shopping areas. Transportation has ground to a halt in affected areas. In Songkhla Province, the government has called for steps to be taken to prevent further flooding of the commerial district of Hat Yai. Rail tracks have been lifted in some areas to permit flood waters to leave the city, and the Thai Navy has been ordered to take part in relief efforts.

In Muang District of Nakhon Sri Thammarat, many roads have been closed and sandbags are being deployed to help affected businesses. Schools throughout the province have been closed because of flooding conditions. Other provinces, including Phattalung, Pattani, Yala, Narathiwat, Trang, Sukhothai and Satun have experienced similar problems with high tides and heavy rain paralysing much of the region.

The Meteorological Department of the Thailand Ministry of Information and Communication Technology issued a weather advisory concerning the flooding, “People in the lower South and navigators in the Gulf of Thailand should exercise caution and small boats should stay from December 15 until December 18.” It is reported that this has left some tourists stranded on smaller resort islands in the Gulf of Thailand.

Across the border in Malaysia, three are reported to have died and over 10,000 been evacuated as a result of the flooding.

Australia men’s national wheelchair basketball team beat Japan 80-49 in final game of pool play

Homebush Bay, New South Wales —Last night, the Australia men’s national wheelchair basketball team beat Japan 80–49 in their final game of pool play at the Rollers & Gliders World Challenge taking place at at the Sport Centre at the Sydney Olympic Park and are through to the first place match.

The contrast between the two teams was seen in their wheels: almost every Australian player had a four wheeled chair that gave them increased stability while every single Japanese player had three wheels, which gave them great maneuverability. Japan played the aggressor throughout the match, with several players aggressively blocking with wheelchair on wheelchair contact. Both sides were loud, chanting defense, defense, defense when their side was on that side of the court.

The first quarter was closely fought, with Japan racking up 5 by 5:54 left in the first. They successfully took a lead of 17–16 by the end of the first quarter. They were unable to hold the lead, with Australia holding a 40–24 lead at the end of the first half. Australia’s lead at the end of the third was 61–34. While Japan increased their total points in the fourth quarter, they failed to defend against Australia who continued to answer back basket for basket for the game to end 80–49.

Australia plays in the first place match later today. Their London Paralympic campaign starts on August 30 against South Africa.

Yahoo triples its quarterly profit on strong advertising revenue

Yahoo!, the world’s favorite Internet destination, reported $373 million in net income for the three month period ended December 31. Revenues were $1,078 million for the fourth quarter of 2004, a 62 percent increase compared to $664 million for the same period of 2003. “We are attracting more and more users to Yahoo!’s network of services and driving their usage deeper with more relevant products and services. This deeper usage is the real magic behind the surpassing of our financial objectives,” explained Susan Decker, the company’s chief financial officer.

  • Revenues excluding traffic acquisition costs (“TAC”) were $785 million for the fourth quarter of 2004, a 54 percent increase compared to $511 million for the same period of 2003
  • Gross profit for the fourth quarter of 2004 was $691 million, a 56 percent increase compared to $443 million for the same period of 2003
  • Operating income for the fourth quarter of 2004 was $235 million, a 149 percent increase compared to $94 million for the same period of 2003

The first rule of an accessible garden is that you cannot garden if you cannot get there. An accessible garden has paved areas, a wide ramp to areas at different levels if you use a walker or wheelchair, raided beds, a sitting area, container plants if all the plants are not in the raised beds, a kneeling bench if you will be kneeling, and sturdy handrails. Doors to the garden should be at ground level or a wide ramp should lead from the house to the garden.

Water should be readily available in the garden. It is ideal to have faucets in the immediate garden area. If there is no faucet, pull a hose to the garden and leave it there. You can also have a barrel of water from which to fill watering cans, although this would only be for spot watering. A drip system can be supplemented by watering from a watering can but watering the whole garden with a watering can is too tedious to be worthwhile.

There can be a number of hazards associated with steps in the garden.

Treads that are too narrow. Treads should be at least 11 inches wide.

Nosings that protrude can be a tripping hazard.

Open risers can also cause tripping

Smooth surfaces can be very slippery when wet. Attach indoor/outdoor carpet or pieces of rubber mat to the steps to make them safe

Loose or lacking railings. Make sure there is a sturdy railing. 30 to 34 inches above the ground is best for most people but have it installed at the height that suits you best.

Ideally gardens for people with physical limitations should be all one level and on smooth surfaces. If that is not possible a ramp can be built from one flat area to another.

Ramp slope should be no more than one inch of rise for 12 inches.

Ramp width should be at least 36 inches wide.

Ramp surfaces should be non-skid. Textured concrete, bricks, rough wood or crushed gravel are good ramp surfaces. Pea gravel, smooth wood or smooth concrete are not as good.

Garden paths should be wide at least 30 inches or wider. Gates should be at least 42 inches wide.

The path surface should be firm and even. Hard surfaces can be expensive and you will probably need to have someone install them for you, but they are safe and comfortable. Gravel is less expensive however wheels tend to sink into it and can be hard to walk on. You can modify a gravel path by covering it with indoor outdoor carpet. Hard-packed soil is cheap, but it is usable only in dry weather.

Storing tools in the garden makes the work much easier. If the tools are handy you will be able to get more work done before you need to sit and rest.

To make gardening easier:

Know your soil. Fill your raised beds with improved garden soil and grow only plants that can tolerate the native soil where you have not improved the soil

Know your climate. Grow plants that are adapted to the conditions in your area.

Limit lawn area. If you cant mow it can be expensive to pay someone to keep up with a large expanse of grass.

Use disease and insect resistant plants. It is better to avoid problems in the first place than to have to fight insects and disease.

Keep garden tools and supplies within reach.

Locate your garden near a water source.

Mulch to control weeds.

Start small. Dont try to transform the whole yard at once.

Stop often to sit and enjoy.

Former New York City Police Commissioner Bernard Kerik sentenced to four years in prison

Former New York City Police Commissioner Bernard Kerik was sentenced to four years in prison and three years of supervised release on Thursday after pleading guilty to eight felony charges. Among these were tax fraud and lying to Bush administration officials during his unsuccessful nomination for US Secretary of Homeland Security in 2004.

This sentence is contrary to a plea agreement made in November between Kerik’s legal counsel and the prosecution. Per this accord, federal attorneys recommended a sentence of no longer than 33 months in prison, opposed to the 48 months that US District Judge Stephen Robinson (who was not bound to this agreement) chose to hand down instead.

“I think it’s fair to say that with great power comes great responsibility and great consequences,” Judge Robinson said upon sentencing. “I think the damage caused by Mr. Kerik is in some ways immeasurable.”

“Today’s sentencing of Bernard Kerik is one of the most powerful recent reminders that no one in this country is above the law,” added US Attorney Preet Bharara.

Kerik, who was accompanied by his wife and three children, briefly addressed the court: “I make no excuses. I take full responsibility for the grave mistakes I’ve made. Believe me when I say I have learned from this and I have become and will continue to become a better person.”

“I know I must be punished,” he went on to say. “I only ask that you allow me to return to my wife and two little girls as soon as possible.”

According to the New York City Department of Corrections, Kerik is slated to begin serving his sentence on May 17. Although the prosecution made clear their desire for Kerik to be imprisoned immediately, Judge Robinson allowed him to surrender himself later in the day so that he would have sufficient time to “get his affairs in order.” Kerik has been awaiting sentencing under house arrest at his home in Franklin Lakes, New Jersey since November when said plea agreement was reached.

Kerik, a military veteran and undercover detective, was a trusted advisor to former US Attorney and Mayor Rudolph Giuliani, for whom he worked for as a bodyguard and a driver.

Kerik later served as both corrections and police commissioner. His distinguished actions following the 2001 September 11th Attacks transformed him into a respected national figure. This earned him the praise of then-president George W. Bush, who in turn nominated him for the lead Homeland Security post. It was during the vetting process that Kerik’s suspected ties to organized crime came out. This marked the beginning of his long fall from grace.

Outside the courthouse, Kerik gave a statement to the media and general public before being driven home: “I’d like to apologize to the American people for the mistakes I have made and for which I have just accepted responsibility. As history is written, I can only hope that I will be judged for the 30 years of service I have given to this country and the City of New York. It has not and will not diminish my love for this country.”

Kerik’s lawyer, when asked by The New York Times if they planned to appeal this sentence, simply replied, “No comment.”
